Annotation: This article provides a comprehensive scientific analysis of the procedural aspects of the institution of the defender's participation in the criminal courts of the highest instance, discusses the issues of improving the system of lawyer’s participation, the development of the institution of the defender’s participation in cases considered by the court of appeal and cassation, as well as the study of the status, role and legal regulation of the defender in criminal cases., a proposal for implementation in domestic legislation advanced foreign experience and skills of a defender according to recommendations, related to the creation of mechanisms for effective work in criminal proceedings and recommendations have been developed.
