Annotation: This article is aimed at the legal improvement of the judicial review of cases arising from legal relations concerning mortgage agreements under the legislation of the Republic of Uzbekistan. It provides a detailed analysis of the specific features and distinctions of these types of disputes from other categories of cases. The article examines the increasing complexity and growing number of disputes related to mortgage agreements, often caused by the creditor’s failure to comply with the principles of fairness. These circumstances necessitate the study of foreign experience in resolving such disputes. In many developed countries, alternative dispute resolution methods before court proceedings are effectively used to settle mortgage-related disputes. Therefore, the article also discusses the advantages and disadvantages of resolving mortgage disputes through pre-trial alternative dispute resolution mechanisms.
