Annotation: 本文分析汉语立法语言中的“的”字结构的句法功能。学界通常将其界定为后置关系小句，但此概念存在形式与功能之间的内在矛盾。基于法理条文“法定条件-法律后果”的模式化表达，将“的”字结构定义为表假设条件的“如”字结构可能更有利于解释法律文本中的“的”字结构。 This article considers the syntactic function of the “de” structure in Chinese legislative language. The “de” structure in a legal context has been routinely defined as the post-posed relative clause, despite the inherent conflict between its form and function. In view of the “legal assumption – legal consequence” pattern of expression in legal clauses, defining the “de” structure as the “ru” structure will offer more persuasive explanations in the legal context
